1. Acceptance of Terms

By accessing www.elegaarts.com and purchasing our products, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website.

2. Physical Products & Fulfillment

All products sold on Elega Arts are physical goods. Our products are made-to-order and fulfilled by our partner, Printful. By placing an order, you acknowledge that your shipping information will be shared with our fulfillment partner to process and deliver your purchase.

3. Intellectual Property

All designs, images, text, and content on this website are the intellectual property of Elega Arts and are protected by Canadian and international copyright laws. Purchase of a physical product does not transfer any copyright or distribution rights to the buyer. You may not reproduce or resell our designs in any form.

4. Shipping and Delivery

Production Time: Since products are made-to-order, please allow for a standard fulfillment period before shipping.
Shipping Rates & Times: Shipping costs and estimated delivery dates are calculated at checkout. Elega Arts is not responsible for delays caused by shipping carriers or customs clearance.
Address Accuracy: You are responsible for providing a correct and complete shipping address. We are not liable for orders delivered to an incorrect address provided by the customer.

5. Returns and Refunds

Because our products are printed on demand, we do not accept returns or exchanges for buyer’s remorse (e.g., ordering the wrong size or changing your mind).

Damaged or Defective Items: Any claims for misprinted, damaged, or defective items must be submitted within 30 days after the product has been received. Please contact us with photos of the issue.
Lost in Transit: For packages lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date.
Approved Refunds: If a return or reshipment is approved due to an error on our part or the fulfillment center’s part, we will cover the costs.

6. Payment and Pricing

Prices are displayed in the currency specified on the website (e.g., CAD or USD).
We reserve the right to change prices at any time without notice.
You agree to provide current, complete, and accurate purchase information for all transactions.

7. Accuracy of Colors and Mockups

We strive to display our products as accurately as possible. However, because computer monitors display colors differently and the printing process on physical materials (canvas, cotton, etc.) can vary, we cannot guarantee that the physical product will perfectly match the color on your screen.

8. Limitation of Liability

To the fullest extent permitted by law, Elega Arts shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of our products or website.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontarioand the laws of Canada.
